What statutory registers are mandatory for a housing society in Maharashtra?
Under Section 79 of the MCS Act 1960 and Rules 32 & 33 of the MCS Rules 1961, every society must maintain permanent bound physical registers: Register of Members (Form 'I'), List of Members (Form 'J'), Share Transfer Register, Nomination Register, Minutes Books, and Sinking Fund Ledgers. Failure to maintain them invites penalties and committee supersession.
The 6 Core Mandatory Statutory Registers
Register of Members (Statutory Form 'I')
The primary legal register of the society. Contains member serial number, full name, residential address, occupation, date of admission, distinct numbers of shares held, share certificate number, date of cessation of membership, and nominee particulars. Must be bound physically.
List of Members (Statutory Form 'J')
Alphabetical or serial flat-wise directory of all current active members. Establishes the authoritative voting roll for General Body Meetings (AGMs/SGMs) and society committee elections. Kept open for member inspection during office hours.
Share Transfer Register
Chronological log of every share transfer executed in the society. Records transferor details, transferee details, resolution numbers of Managing Committee approval, date of transfer endorsement, and statutory fee payment receipts.
Nomination Register
Maintains member nominations submitted in Appendix 14. Records nominee names, percentage shares allocated, relationship to member, dates of submission, and formal entry confirmation by the Secretary.
Minutes Books (Managing Committee & General Body)
Pre-numbered, physically bound books containing verbatim recording of all Managing Committee meetings, Annual General Meetings, and Special General Body Meetings. Must be signed by the Chairman and Secretary.
Sinking Fund & Investment Register
Tracks the accumulation of Sinking Fund and Reserve Fund levies, interest accruals, and their investment in authorized cooperative or nationalized bank fixed deposits under Section 70.
Member Statutory Right of Register Inspection (Section 79)
Section 79 RightsUnder Section 79 of the MCS Act, every bona fide member of the society has a statutory right to inspect the Register of Members (Form 'I'), List of Members (Form 'J'), audited accounts, and society bye-laws during office hours free of charge, or obtain certified copies upon paying prescribed copying fees under Bye-Law 172.
