What is the Builder-to-Society Handover Process in Maharashtra?

Under the Maharashtra Ownership Flats Act (MOFA) and RERA, a developer must hand over society administration, common assets, and collected corpus funds to an elected Managing Committee upon registration of the Cooperative Housing Society. The takeover requires four synchronized reconciliations: legal title verification, financial corpus audit, MEP infrastructure snagging, and statutory register formalization.

1. Legal, Title & Municipal Documents

Sanctioned Architectural Plans (As-Built Drawings) with Municipal Corporation approval stamps
Commencement Certificate (CC) & Full Occupation Certificate (OC)
Title Certificate & Search Report by Builder's Advocate (30 years title chain)
Deemed Conveyance readiness dossier & Original registered Agreements for Sale copies
Environmental Clearance & Chief Fire Officer (CFO) Final Fire NOC
Electricity Sub-station / Transformer handover NOC from relevant Distribution Licensee (MSEDCL / Tata Power / Local Discom)

2. Financial & Corpus Fund Reconciliation

Statement of Corpus Fund collected from members with bank transfer reconciliation
Statement of Sinking Fund & Maintenance Deposits collected by developer
Audited Income & Expenditure account for the builder-managed maintenance period
Clearance of all utility arrears (property tax, commercial water bills, electricity dues) up to handover date
Transfer of security deposits for water connections and power meters to society name
Vendor contract payment clearance certificates with zero outstanding contractor liabilities

3. Technical & Plant Infrastructure Snagging

Passenger & Service Lift licenses issued by PWD Lift Inspector and original warranty certificates
Diesel Generator (DG Set) installation clearance, warranty, and electrical inspection certificate
Fire-fighting system operational pressure test report and wet-riser certificates
Sewage Treatment Plant (STP) and Water Treatment Plant (WTP) performance parameters report
Water supply pumps, pressure boosting systems, and rainwater harvesting test reports
CCTV cameras, boom barriers, access control, and intercom system manuals and master passwords

4. Statutory Registers & Society Formalities

Initialization and formal physical handover of Register I (Register of Members)
Initialization of Register J (List of Members) and Share Transfer Register
Handover of blank / signed Share Certificates for all allottees
Society official stamp, seal, and letterhead custody handover
Formal Minutes of Handover Meeting signed jointly by Builder Representatives and Managing Committee
Filing of Handover Intimation with the District Deputy Registrar (DDR) of Cooperative Societies
